In this Privacy Policy, “we” and “us” refers to Air Charter Service and “you” refers to any individual about whom we collect personal information.

What information does Air Charter Service collect about you?

We collect personal information when recruiting and hiring personnel, this is known as you ‘Employee Record’.

An employee record is defined under section 6(1) of the Privacy Act 1988 (Cth). Employee record, in relation to an employee, means a record of personal information relating to the employment of the employee. Examples of personal information relating to the employment of the employee are health information about the employee and personal information about all or any of the following:

a) the engagement, training, disciplining or resignation of the employee;
b) the recruitment of the employee, including results of ability and psychometric tests;
c) the termination of the employment of the employee;
d) the terms and conditions of employment of the employee;
e) the employee’s personal and emergency contact details;
f) the employee’s performance or conduct;
g) the employee’s hours of employment;
h) the employee’s salary or wages;
i) the employee’s membership of a professional or trade association;
j) the employee’s trade union membership;
k) the employee’s recreation, long service, sick, personal, maternity, paternity or other leave;
l) the employee’s taxation, banking or superannuation affairs.
m) the engagement, training, disciplining, resignation or termination of employment of an employee
n) the terms and conditions of employment of an employee
o) the employee's personal and emergency contact details, performance or conduct, hours of employment or salary or wages
p) the employee's membership of a professional or trade association or trade union membership

    How and why does Air Charter Service collect and use your personal information?

    Air Charter Service may collect personal information from you whenever you input such information into the website.

    We generally collect personal information directly from you. We may collect and update your personal information over the phone, by email, over the internet or social media, or in person. We may also collect personal information about you from other sources, for example:

    a) our affiliated and related companies; and

    b) third party suppliers and resources such as test providers, job agencies or social media platforms.

    We also collect cookies from your computer which enable us to tell when you use the website and also to help customise your website experience. A “cookie” is a small file stored on your computer's browser, which assists in managing customised settings of the website and delivering content. We collect certain information such as your device type, browser type, IP address, pages you have accessed on our websites and on third-party websites. As a general rule, however, it is not possible to identify you personally from our use of cookies.

    The purposes for which Air Charter Service usually collects and uses personal information depends on the nature of your interaction with us, but may include:

    a) performing our agreement with you;
    b) drafting a proposed agreement;
    c) verifying your identity;
    d) ensuring business records are correct and up to date;
    e) responding to requests for information and other general inquiries;
    f) managing, planning, advertising and administering programs, events, and performances;
    g) researching, developing and expanding our facilities and services;
    h) informing you of our activities, events, facilities and services;
    i) recruitment processes (including for volunteers, internships and work experience); and
    j) responding to enquires and complaints

    How does Air Charter Service hold information?

    Air Charter Service stores information in paper-based files or other electronic record keeping methods in secure databases (including trusted third party storage providers based in Australia and overseas). Personal information may be collected in paper-based documents and converted to electronic form for use or storage (with the original paper-based documents either archived or securely destroyed). We take reasonable steps to protect your personal information from misuse, interference and loss and from unauthorised access, modification or disclosure.

    Air Charter Service maintains physical security over paper and electronic data stores, such as through locks and security systems at our premises. We also maintain computer and network security, for example, we use firewalls (security measures for the internet) and other security systems such as user identifiers and passwords to control access to our computer systems.

    We take steps to destroy or de-identify information that we no longer require.

    Does Air Charter Service disclose your personal information, including disclosure overseas?

    Air Charter Service can only use or disclose personal information for a purpose for which it was collected (known as the ‘primary purpose’), or for a secondary purpose if an exception applies under the Australia Privacy Principles. This includes external third-party service providers, such as accountants, auditors, experts, lawyers and other outside professional advisors; IT systems, support and hosting service providers; printing, advertising, marketing and market research and analysis service providers; document and records management providers; technical engineers; data storage and cloud providers and similar third-party vendors and outsourced service providers that assist us in carrying out business activities.

    Air Charter Service is a member company of global entity, Mountfitchet Group. We may share your personal data with certain members of our group companies. Where they have access to your personal data they will use it only for the purposes set out in this Privacy Notice. Air Charter Service will remain responsible for the management and security of jointly used Personal Information. Access to Personal Information within Air Charter Service, and our group of companies, is restricted to those individuals who have a need to access the information for our business purposes.

    Unless we have your consent, or an exception under the Australian Privacy Principles applies, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient does not breach the Australian Privacy Principles in relation to your personal information.

    Entities which are related entities of Air Charter Service or are otherwise affiliated with Air Charter Service have operations in https://www.aircharterservice.com.au/contact. In circumstances where your information is disclosed to overseas recipients, those recipients are likely to be located in countries in the regions in which Air Charter Service and its related entities and affiliates operate.

    If your personal information is sent to a recipient in a country with data protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your personal information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your personal information is mishandled in that jurisdiction. If your personal information is transferred to a jurisdiction which does not have data protection laws as comprehensive as Australia's, we will take reasonable steps to secure a contractual commitment from the recipient to handle your information in accordance with the Australian Privacy Principles.

    How long will Air Charter Service keep my data?

    When you create a profile, we will retain the personal data for a period of 24 months after your last login You will be informed about the deletion of your profile via email. You may delete your profile at any time before the expiry of this period.

    In respect of other information collected, where Air Charter Service no longer needs personal information for any purpose for which the information may be used or disclosed under the Australian Privacy Principles, we will take reasonable steps to destroy the information or ensure that it is de-identified

    Is my personal information secure?

    Air Charter Service is committed to keeping your personal data safe and secure from unauthorised access to or unauthorised alterations, disclosure or destruction of information that we hold.

    a) Our security measures include:
    b) encryption of our services and data;
    c) review our information collection, storage and processing practices, including physical security measures;
    d) access control restrictions for personal information;
    e) contractual confidentiality and processing agreements for employees and/or third parties who may require access to personal data; and
    f) internal policies setting out our data security procedures and training for employees.

    How can you access or seek correction of your personal information?

    Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions.

    You are entitled to access your personal information held by Air Charter Service on request. To request access to your personal information please contact our privacy officer using the contact details set out below.

    You will not be charged for making a request to access your personal information but you may be charged for the reasonable time and expense incurred in compiling information in response to your request.

    We will take reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete and up-to-date. You can help us to do this by letting us know if you notice errors or discrepancies in information we hold about you and letting us know if your personal details change.

    However, if you consider any personal information we hold about you is inaccurate, out-of-date, incomplete, irrelevant or misleading you are entitled to request correction of the information. After receiving a request from you, we will take reasonable steps to correct your information.

    We may decline your request to access or correct your personal information in certain circumstances in accordance with the Australian Privacy Principles. If we do refuse your request, we will provide you with a reason for our decision and, in the case of a request for correction, we will include a statement with your personal information about the requested correction.

    What should you do if you have a complaint about the handling of your personal information?

    You may contact Air Charter Service at any time if you have any questions or concerns about this Privacy Policy or about the way in which your personal information has been handled.

    You may make a complaint about privacy to the privacy officer at the contact details set out below.

    The privacy officer will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint. We will generally respond to your complaint within a week.

    If your complaint requires more detailed consideration or investigation, we will acknowledge receipt of your complaint within a week and endeavour to complete our investigation into your complaint promptly. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.

    In most cases, we will investigate and respond to a complaint within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know.

    If you are not satisfied with our response to your complaint, or you consider that Air Charter Service (Aust) Pty Limited may have breached the Australian Privacy Principles or the Privacy Act, a complaint may be made to the Office of the Australian Information Commissioner.     How changes are made to this Privacy Policy?

    Air Charter Service will occasionally update this Privacy Notice in accordance with business and legal requirements. We will post a notice of any material changes on our website, and where appropriate, notify you using the contact details we hold for you for this purpose. We encourage you to periodically review this Notice to be informed of how we use your information.
